Decision to list medical devices supplied by Philips New Zealand Commercial Limited

What we’re doing
We are pleased to announce the approval of listing agreements with Philips New Zealand Commercial Limited (“Philips”) for the supply of medical devices to Health New Zealand | Te Whatu Ora hospitals in the following category:
In summary this will result in:
- Listing of medical devices in the medical imaging, software and associated products category supplied by Philips in Part III of Section H of the Pharmaceutical Schedule from 1 May 2024 under a national agreement that all Health New Zealand hospitals may purchase under; and
- Health New Zealand hospitals being able to continue to purchase other suppliers’ brands of medical imaging, software and associated products as the agreement is not for sole supply.
Any changes to the original proposal?
This decision was subject to a consultation letter dated 4 September 2023.
Changes to the product list, and terms and conditions have been made as a result of consultation feedback.

Details about this decision
In November 2020 Pharmac and NZHP released an RFP:
The RFP was for non-exclusive national agreements for listing on the Pharmaceutical Schedule.
Pharmac has been working with suppliers who responded to the RFP to seek provisional agreements.
After consulting on the provisional agreement with Philips, Pharmac has decided to list Philip’s medical imaging, software and associated products in Part III of Section H of the Pharmaceutical Schedule from 1 May 2024.
Health New Zealand hospitals can continue to choose which medical imaging, software and associated products they procure, including from other suppliers. Health New Zealand hospitals that procure medical imaging, software and associated products from Philips must ensure they do so under the terms and conditions, including pricing, in the agreement from 1 May 2024.
Our response to what you told us
We’re really grateful for the time people took to respond to this consultation. Feedback was received from Health New Zealand in relation to the terms and conditions in the agreement. Pharmac has worked with Health New Zealand to understand the concerns raised and revise the terms and conditions of the agreement with Philips.
