Details about this decision

Between 2016 and 2018 PHARMAC issued Requests for Proposals ("RFPs") for:

These RFPs were for non-exclusive national agreements for listing in the Pharmaceutical Schedule.

After completing the RFP evaluation processes, and consulting on the provisional Agreement reached with Medtronic, PHARMAC has decided to list Medtronics’ medical devices in Part III of Section H of the Pharmaceutical Schedule from 1 November 2019.

The list of products will be available on PHARMAC's website from 1 November 2019, in both a PDF document and an Excel spreadsheet

DHBs can continue to choose which anaesthesia small equipment and consumables, interventional radiology products, patient warming and cooling products, respiratory equipment and consumables, and single use instruments they purchase, including those from other suppliers. DHBs that purchase medical devices in the categories above, from Medtronic, must do so under the terms and conditions, including pricing, in the Agreement, from 1 November 2019.

The Agreement includes terms and conditions for training and education to be provided by Medtronic on the appropriate use and maintenance of its products, which is to be provided at times as agreed with individual DHBs.

Comment

No technical or resource impacts anticipated as a result of the proposal.

Noted.

Clarification sought from a clinician regarding whether the proposal would limit DHBs ability to purchase equivalent products from other suppliers.

The proposal is not for sole supply and DHBs can purchase equivalent products from other suppliers.

Clarification sought from a supplier regarding PHARMAC’s ability to list a range of anaesthesia products that are currently listed on the Pharmaceutical Schedule from another supplier.

The RFP processes did not limit multiple suppliers having the same range of products listed on the Pharmaceutical Schedule where a supplier has the distribution rights to do so.
